By registering for and/or participating in any Tenafly Nature Center (“TNC”) program or event, all registrants (and, where applicable, the parent or legal guardian of a minor registrant) hereby acknowledge, certify, and agree to the following waivers and releases:
Waiver of Liability
I hereby waive, release, and discharge any and all claims for damages, including but not limited to death, personal injury, or property damage, which I may have or which may hereafter accrue to me, against the Borough of Tenafly and/or the Tenafly Nature Center Association, arising out of or in connection with my participation in the program/event for which I am registered.
I understand and expressly acknowledge that participation in a TNC program or event is voluntary and undertaken at my (or my child’s) own risk. I further recognize that TNC is a natural environment containing both known and unknown hazards, and that it is impossible to eliminate or guard against all such hazards. These may include, but are not limited to, risks associated with insects (including ticks), wild or domesticated animals, plants, uneven terrain, weather conditions, and other natural or man-made features of the premises.
I acknowledge that accidents and injuries may occur as a result of my participation, and I hereby agree to release and hold harmless the Borough of Tenafly, the Tenafly Nature Center Association, their trustees, officers, employees, council members, agents, and volunteers, as well as any public agencies, from any and all liability, claims, or demands arising out of or connected in any way with such participation. This waiver and release shall be binding upon my heirs, executors, administrators, and assigns.
I further certify that I have read and fully understand this Waiver of Liability, that the risks associated with participation have been explained to me, and that I sign/agree to this instrument of my own free will, without coercion or undue influence. If any portion of this waiver is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Photo and Media Release
I hereby grant the Tenafly Nature Center Association the irrevocable right and permission to use my and/or my child’s likeness, image, or voice in photographs, video recordings, or any other media now known or hereafter existing. Such media may be used in TNC’s publications, marketing materials, educational content, or other media, in perpetuity and without restriction.
I waive any right to compensation, monetary or otherwise, and agree not to assert any claims, including but not limited to claims of invasion of privacy, defamation, or misappropriation, arising from the use of such media.
